Shoply Shoply Privacy Policy

Terms of Service

The agreement between Shoply and the people who open a store here.

1.Who this is between

Shoply is a platform for selling digital goods: licence keys, accounts, files and other things that are delivered rather than posted. This document is the agreement between Shoply and you, the person who opens an account here to sell.

It is not the agreement between you and the people who buy from your store. That one is yours to write, in Settings, and it is what your buyers see at your checkout.

2.Your account

  • You need to be old enough to enter a contract where you live, and you need to give a real email address that you can receive mail at.
  • One person, one account. An account may hold up to five stores.
  • What happens under your account is your responsibility, including anything done by somebody you gave access to. If you think somebody else is in it, tell us.
  • You can sign in with a password or with a connected Google account. Either way, keeping that sign-in safe is on you.

3.What you may sell

You are responsible for everything you list. You may not use Shoply to sell or distribute:

  • anything you do not have the right to sell, including pirated software, cracked accounts, stolen keys and other people's copyrighted work;
  • access to accounts belonging to somebody else, or credentials obtained from a breach;
  • malware, stealers, botnets, or tools whose purpose is to break into systems that are not the buyer's own;
  • anything illegal where you are, where we are, or where your buyer is;
  • anything that breaks the rules of a payment provider we use, which for card payments means Stripe's restricted business list.

Selling something and describing it honestly are the same obligation. A listing that hides what a buyer is actually getting is a breach of this section even if the thing itself is allowed.

4.Your obligations to your buyers

  • Write your own Terms of Service and Refund Policy and keep them accurate. Shoply shows them at your checkout; it does not write them for you.
  • Deliver what you sold. Answer your buyers. Handle your own refunds and disputes.
  • Work out your own taxes. Shoply does not calculate, collect or remit tax for you.
  • Handle your buyers' personal data lawfully. See the Privacy Policy for how that data sits between us.

5.Money

Shoply does not hold your money. Payments go through the processors you connect — Stripe for cards, NOWPayments for cryptocurrency — and they pay you directly under their own agreements with you. Their fees, their payout schedules and their decisions about your account are theirs, not ours.

A chargeback or a reversed payment is between you, your buyer and the processor. Shoply records what happened; it cannot undo it.

6.Your content, and ours

Everything you upload stays yours. You give Shoply permission to store it, serve it and show it, which is what is needed to run your store for you, and nothing beyond that.

Shoply's own software, brand and design stay ours. Running a store here does not give you rights to them.

7.Suspension and closing an account

You can close your account whenever you like. We can suspend or close a store or an account that breaks section 3 or 4, that puts our payment providers or our sending domain at risk, or that we are required to act on. Where it is reasonable to warn you first, we will.

If we close your account, you can ask for a copy of your store data for a reasonable period afterwards.

8.What we do not promise

Shoply is provided as it is. We work to keep it up and we publish its status, but we do not promise it will never be unavailable, never lose a beat, or never have a bug.

To the extent the law allows, Shoply is not liable for money you did not make, sales you did not complete, or data a third-party provider lost. Nothing here limits liability that cannot legally be limited.

9.Changes

We may change this document. The date at the top says when it last changed, and if a change matters to you we will tell you by email before it takes effect. Carrying on using Shoply after that is how you accept it.
